End User Licence Agreement (EULA)

IMPORTANT: PLEASE READ THIS END USER LICENCE AGREEMENT (“EULA”) CAREFULLY BEFORE INSTALLING OR USING THE MY HOME CALL APPLICATION.

This EULA is a legal agreement between you (“End User” or “you”) and My Home Call Ltd. (“My Home Call,” “we,” “us,” or “our”) for the My Home Call software application and any associated media, printed materials, and “online” or electronic documentation (collectively, the “Application”).

By installing, accessing, or using the Application, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not install, access, or use the Application.

Effective Date: June 05, 2025

1. Grant of Licence

Subject to the terms and conditions of this EULA, My Home Call grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Application on a compatible device owned or controlled by you for your personal, non- commercial use.

2. Licence Restrictions

You agree not to, and you will not permit others to: Reproduce, modify, adapt, translate, publish, display, communicate, transmit, sell, rent, lease, sublicense, loan, distribute, or otherwise transfer the Application or any portion thereof. Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application, except as permitted by applicable law. Make any copies of the Application. Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) of My Home Call or its affiliates, partners, suppliers, or licensors. Use the Application for any unlawful purpose or in any manner inconsistent with this EULA.

3. Intellectual Property Rights

The Application, including all copyrights, patents, trademarks, trade secrets, and other intellectual property rights associated therewith, are and shall remain the sole and exclusive property of My Home Call Ltd. You are granted only a limited licence to use the Application in accordance with this EULA, and no ownership rights are transferred to you.

4. User Data and Privacy

The Application allows you to securely store emergency contact details and vital medical information in the cloud. You are solely responsible for the accuracy and completeness of the data you provide. By storing data, you expressly consent to its storage and temporary access as described in our Terms of Use and Privacy Policy. You acknowledge and agree to use your device’s biometric authentication (e.g., Face ID or fingerprint) for secure access to your profile. You understand that when your profile is accessed from another device (e.g., by a first responder), your information is visible for no more than 15 minutes before becoming inaccessible from that device. If enabled in your settings, your What3Words location will be sent to selected emergency contacts when your profile is accessed. Your use of the Application is also governed by our Privacy Policy, which is incorporated into this EULA by reference. Please review our Privacy Policy for more detailed information on data collection, use, and security.

5. Pilot Launch and Fees

The Application is currently offered under a pilot launch program. During the pilot launch, the Application is available at a reduced fee of £5.95 per year. By subscribing, you agree to the billing cycle and cancellation policies applicable to this pilot program, as communicated during the subscription process. My Home Call reserves the right to adjust fees after the pilot phase, with prior notice.

6. Important Disclaimer Regarding Emergency Services

MY HOME CALL IS NOT A REPLACEMENT FOR EMERGENCY SERVICES. While the Application provides secure access to your medical information, emergency services are not yet directly integrated with our system or using the data from My Home Call.

IN ANY LIFE-THREATENING SITUATION, YOU MUST ALWAYS DIAL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY (e.g., 999 in the UK, 911 in the US).

My Home Call is a supplementary tool intended to assist in situations where you or others need quick access to your personal and medical information, but it is not a substitute for direct communication with official emergency services.

7. No Warranty

THE APPLICATION IS PROVIDED “AS IS,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. MY HOME CALL HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APPLICATION, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. MY HOME CALL DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE APPLICATION WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE APPLICATION WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT DEFECTS IN THE APPLICATION WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY HOME CALL OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, OR LOSS OF PRIVACY) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APPLICATION, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF MY HOME CALL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

9. Eligibility and Appropriate Use

You must be 13 years or older to register. Users under 13 must have parental or guardian consent. You agree to use the Application only for personal safety and communication in genuine emergencies. You may not use the Application for any unlawful, fraudulent, or abusive purposes, or in any manner that could damage, disable, overburden, or impair My Home Call’s servers or networks.

10. Termination

This EULA is effective until terminated by you or My Home Call. Your rights under this EULA will terminate automatically without notice from My Home Call if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the Application and destroy all copies, full or partial, of the Application.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in England and Wales to resolve any dispute arising out of or relating to this EULA or the Application.

12. Entire Agreement

This EULA constitutes the entire agreement between you and My Home Call regarding the use of the Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
